Will Trusts:

Property Will Trusts help ensure your own children or other beneficiaries inherit your share of your home whilst allowing your spouse or partner to continue occupying the home after your death. They can also protect your share of your home should your spouse or partner re-marry or from Care Home fees if your surviving partner has to enter Nursing or Residential Care later in life.

If you are a sole property owner, then Lifetime Interest Trusts allow your spouse, partner or another person to continue living in the home after your death whilst guaranteeing that your children or other beneficiaries will eventually inherit the property.

Disabled Discretionary Trusts can help protect disabled persons State Benefits when they inherit from you, whilst ensuring that the inheritance is handled correctly by responsible Trustees of your choice.

There are several types of Discretionary Trusts that can be drafted in many ways. As an example, some allow your partner or other persons to receive most or all of the interest earned from your estate whilst guaranteeing that your beneficiaries will eventually inherit the capital.

 

Lasting Powers of Attorney:

Whilst you are alive, if through ill health or loss of mental capacity you are unable to handle your own financial or personal affairs, the Lasting Powers of Attorney documents allow you to nominate one or more persons to handle your affairs either now or in the future. By preparing Lasting Powers of Attorney in advance, future delays, large Court costs and continued Court applications to alter any welfare decisions can be averted.

 

Probate (Administration of Estates):

When a person dies, in most cases the Executors of a Will have to apply to the courts for a Grant of Probate. This then allows them to legally collect the money, property and possessions of the deceased, pay any estate debts and then distribute the balance to the beneficiaries entitled to it.

Unfortunately, dealing with beneficiaries and any potential disputes plus the Probate Court, Banks, Insurance Companies, Tax Office, the many other authorities that have to be informed plus the selling of any properties can be a daunting task, especially when the Executor is also going through their own grieving process.
